Terms of Service

These are the terms between you (the business that signs up) and JessieAnswers, operated by Web Infinity Limited, New Zealand ("we", "us"). By creating an account, ticking the box at signup, or diverting calls to a Jessie number, you agree to them. They are written in plain English on purpose; where a plain reading and a legal reading differ, the plain reading is what we meant.

1. What the service is

JessieAnswers answers phone calls you divert to it, using an AI receptionist ("Jessie"), and gives you the resulting leads, messages, bookings, transcripts and notifications. It is a tool that helps you handle calls. It is not a replacement for your own judgement on quotes, pricing, safety, or your legal obligations to your customers, and it is not an emergency service.

2. Jessie is an AI, and AI makes mistakes

Jessie uses speech recognition and a large language model. That means, some of the time, she will:

  • mishear or misspell a name, number, or address;
  • misunderstand what a caller wants, or answer a question wrongly;
  • book, or fail to book, a time you would have handled differently;
  • send a text that is worded differently from how you would have put it;
  • occasionally fail to answer at all, or drop a call.

We work hard to make these rare, and every call comes with a transcript so you can check what was said. But you accept that Jessie's output is not guaranteed to be accurate, complete or suitable, and that it is your responsibility to review leads, confirm bookings, verify details with the customer, and apply your own professional judgement before you act on anything Jessie tells you. Never rely on Jessie for anything safety-critical: if a caller has an emergency, Jessie tells them to ring 111, and so should you.

3. Plans, minutes and billing

Plans are billed monthly in NZ dollars. All advertised prices include GST. Billing starts when your free trial ends. Minutes beyond your plan's included amount are billed at $0.40 per minute including GST. Spam calls and calls under 15 seconds don't count against your minutes or your bill. If we change a price, we'll give you at least 30 days' notice by email before it applies to you.

4. No contract, cancel anytime

There is no minimum term. Cancel from your dashboard whenever you like. You keep access until the end of your current billing period, and we won't charge you again after that. We don't refund part-months.

5. Your responsibilities

  • The information you give Jessie (your services, prices, hours, service area, FAQs and anything else in your playbook) is accurate, and you keep it up to date. Jessie repeats what you tell her; if it's wrong, what she says will be wrong.
  • You follow up the leads and messages Jessie captures. She catches the call; the job is still yours to win.
  • Your call diverting is set up correctly. We're not responsible for a missed call caused by your own phone, carrier settings, or a divert that wasn't switched on.
  • You have the right to receive calls on the number you divert, and you use the service only for a lawful business.
  • You comply with New Zealand law in how you use what Jessie gives you, including the Privacy Act 2020 for callers' personal information, and the Unsolicited Electronic Messages Act 2007 for any texts or emails you send to callers afterwards. The transactional texts Jessie sends on your behalf during and immediately after a call are part of the service; anything you send later is on you.
  • You don't use the service to mislead callers, to impersonate someone else, to harass anyone, or in a way that damages our phone-carrier standing. If a carrier flags your number for abuse, we can suspend it.

6. Calls, recordings and privacy

Calls to Jessie are transcribed, and may be recorded, so that you can see what was said and so we can improve the service. Jessie lets callers know the call may be recorded, and if a caller asks whether they're speaking to a person she says honestly that she's your AI receptionist. She never claims to be human. How we handle personal information is in our Privacy Policy, which forms part of these terms. You own your business data (your playbook, your leads, your transcripts) and can export or delete it from the dashboard.

7. Third-party services and availability

Jessie is built on phone carriers, cloud hosting, speech and AI providers, and (if you connect them) Google Calendar and Fergus. Those services can and do have outages outside our control. We aim for high uptime and we'll tell you if Jessie is unavailable, but we don't guarantee that the service will be uninterrupted or error-free, and we're not liable for the failure of a service we don't run.

8. What we're not liable for

To the fullest extent New Zealand law allows:

  • We're not liable for indirect or consequential loss (a lost job, lost profit, lost revenue, lost goodwill, or a claim from your customer) however it arises, even if we knew it was possible.
  • We're not liable for loss caused by an error in Jessie's output of the kind described in section 2, or by information you gave us being wrong or out of date.
  • Our total liability to you for everything arising out of the service in any 12-month period is capped at the fees you paid us in the three months before the event that gave rise to the claim.
  • The service is provided "as is", and we don't make any warranty or guarantee beyond what's written here.

You confirm you're acquiring the service for the purposes of a business, so the Consumer Guarantees Act 1993 does not apply, and you agree that it's fair and reasonable that it doesn't. Nothing in these terms excludes or limits any liability that can't lawfully be excluded, including under the Fair Trading Act 1986.

9. Indemnity

You'll indemnify us (that is, cover our losses, costs and any reasonable legal fees) for any third-party claim that arises from the information you put in your playbook, from how you use the leads and messages Jessie gives you, from your breach of these terms, or from your breach of the law. This doesn't apply to the extent the claim was caused by our own negligence or breach.

10. Suspension and ending the service

We can suspend or end your account if you break these terms, don't pay, or use the service in a way that harms other customers or our carrier relationships. We'll tell you why and give you a chance to fix it unless the situation is urgent. We can also withdraw the service altogether with 30 days' notice, in which case we'll refund any prepaid period you don't get to use.

11. Changes to these terms

We may update these terms as the product changes. If a change materially affects you, we'll email you at least 14 days before it takes effect; carrying on using the service after that is acceptance. The current version is always at jessieanswers.nz/terms.

12. Governing law

These terms are governed by New Zealand law and any dispute goes to the courts of New Zealand. If part of these terms turns out to be unenforceable, the rest still applies.
